Irvine CA Real Estate Market Update - March 2012

Irvine CA home selling market continues to be solid with buyer demand.

The average Irvine home for sale list price has now topped $1,000,000 (which is well above the average resold price).

Irvine has 531 homes now listed for resale with average asking price of $1,002,604.

95 of those Irvine homes listed are short sales - 27 of those listed are REOs - So 23 percent of current Irvine listings are distressed properties.

Realtors and brokers resold 2,201 Irvine homes last year during 2011 - average of 183 sold per month - with average sold price of $638,742.

443 of those sold homes last year were short sales (20 percent of market)
218 of those sold homes were REO lender owned after foreclosures (10 percent of market).

121 Irvine homes were resold last month during February 2012

Average resold price for these Irvine homes during February was $565,107.
Average market time for these resales during February 2012 was 116 days.

Since there are 5310 Irvine homes now listed for resale and 121 sold during January, it would theoretically take 4.3 months to sell all homes now listed at this rate. Irvine home resale market is balanced - not favoring buyers or sellers.

REO Sellers of Homes Required to Provide Written Disclosures to Buyers

REO buyers of homes in California should make sure that REO lender/sellers provide all disclosures that are required by law.

REO lender/sellers in California are in some situations exempt from property disclosures to buyers based upon theory that they are not familiar with the properties acquired through foreclosure.

However, REO sellers of residential properties (one to 4 units) in California are required to provide some disclosures to buyers.

REO lender/sellers are not obligated by law to be aware of all property defects, such as foundation cracks, water leaks, plumbing problems, leaky roofs, need for repairs, and they usually don't provide disclosures to buyers of such unknown challenges.

REO property buyers should always hire their own professional property inspections, get complete reports, and be satisfied with information about condition of the property.

California Civil Code 2079 et. seq. generally provides guideline for seller disclosures of material facts required to be given to buyers of one to four residential units.

Lender/sellers in California are required to provide the following disclosures to buyers for REO properties for residential properties one to four units:

92 Newport Beach homes have sold so far this year (January 1 to February 26, 2012) - with average sold price of $1,286,477 - average market time of 117 days for sold homes.

82 Newport beach homes were sold last year during the same time (January 1 to February 26) - with average sold price of $1,235,448 - average market time of 137 days.

So the Newport Beach CA real estate market has improved this year so far with number of home sales up, average sold price up, and average time on market down.

Water-Conserving Plumbing Fixtures Must be Disclosed by California Home Sellers

California government has favored consumers for years and has a number of laws on seller disclosures to protect home buyers.

New CA law - CA Senate Bill 837 - says that home sellers must disclose to buyers whether there are water-conserving plumbing fixtures.

The TRANSFER DISCLOSURE STATEMENT (form provided by California Association of REALTORs) has been revised to include checkbox in Section IIA for a seller to disclose whether the property has water-conserving plumbing fixtures (low-flow toilets, shower heads, and faucets).

This revised transfer disclosure statement (TDS) also clarifies in Section IIB that, by January 1, 2017, a single family residence built on or before January 1, 1994 must generally be equipped with water-conserving plumbing fixtures.

In other words - starting as of January 1, 2017 - any California home built before January 1, 1994, will require water-conserving plumbing fixtures as a point of sale mandate.

If, however, the single-family residence is altered or improved on or after January 1, 2014, the water-conserving plumbing fixtures must be a condition of final permit approval.

CA Senate Bill 837 was chaptered as state law and codified as Cal. Civil Code § 1102.6 - became effective on January 1, 2012.

Buyer Demand for Housing is Up at Orange County CA Real Estate

REALTORs® and real estate professionals and their customers are looking for local market trends.

How is the real estate market? We have something new to talk about when people at Orange County CA ask.

Buyer demand for Orange County CA homes and properties during first 6 weeks of this year 2012 is at highest level as compared with that time each year since 2005.

Steven Thomas at ReportsOnHousing.com measures buyer demand by the number of new pending sales over the prior month, and those pending sales numbers are up.

Buyer demand for Orange County property priced below $500,000 is up 32% as compared with same time last year 2011.

Average market time to sell homes in that range of below $500k is short at 1.6 months and favors the sellers.

For homes priced above $500,000, buyer demand is also up 2%. This is especially positive news considering inventory of Orange County property listed for sale is down 26% from last year.

This real estate news at Orange County CA is good for property owner/sellers. Owners now on the sidelines need to get organized, get their properties cleaned and painted, and listed for sale with an experienced REALTOR® as soon as possible.

We hope for Orange County CA real estate trends that are positive and sustainable - will wait and see whether this news from the first six weeks of 2012 marks a real trend - whether it is supported by escrow closings, and other sales during the next 3 months - with possible window to the housing market recovery.

Options in California Real Estate Contract Transactions

People ask us about possible lease option agreements to sell and buy properties at Orange County, CA.

California real estate contracts sometimes have OPTIONS granted to lessees and proposed buyers.

A rent-to-own or "LEASE OPTION contract" usually contains an OPTION TO PURCHASE clause.

Sometimes developers get separate OPTIONS TO PURCHASE on bare land so they can buy and develop at some time in the future. Adjacent property owners sometimes get a PURCHASE OPTION contract to secure future of neighboring property.

Question is whether any such OPTION TO PURCHASE might be something else - such as a "RIGHT OF FIRST REFUSAL" - where the buyer/optionee gets a right to buy at unknown price to be offered by another party at some time in the future.

A purchase offer to sell property on certain terms can usually be revoked by the owner/offeror any time before it is accepted.

However, if the offeror/seller and offeree/buyer enter an agreement with "independent consideration" delivered to seller, that requires the offer to remain open and irrevocable for a period of time - that's an OPTION TO PURCHASE.

An optionor/seller cannot revoke such OPTION TO PURCHASE if it was granted to optionee/buyer with "independent consideration".

"Independent consideration" means that there must be actual payment or delivery of consideration of some kind (money, motor vehicle, jewelry, etc.) - which needs to be separate and distinct from the payment for the purchase of the property if the option was exercised.

If the option is contained in a lease - LEASE OPTION TO BUY - written and agreed upon provisions of the lease, including the rent to be paid, can be sufficient consideration for the option.

If there is no separate CONSIDERATION actually received by the optionor/seller, that option would remain revocable by seller/optionor. However, if the option is exercised by buyer before it is revoked, the seller/optionor becomes bound under the contract even if there was no consideration.

The option agreement must contain essential material terms of the purchase and sale - identities of the buyer and seller, identity of the property, and the purchase price.

How such OPTION TO PURCHASE is exercised in California

"EXERCISE" of the option is usually by the buyer/optionee - and that would be optionee/buyer's acceptance of the offer to sell the property.

The option agreement can specify how the option is to be exercised - examples are "NOTICE OF EXERCISED OPTION" delivered by hand to the owner/optionor, or by fax, or by confirmed receipt email, or by messenger. If the method is specified in the original option agreement, that must be followed exactly. If no method is specified, the option can be exercised in any reasonable way that gives the seller/optionor notice that the buyer/optionee is accepting the offer and ready to perform.

Investors Set Records Buying More Orange County CA Homes and Real Estate During January 2012

Investor buyers got busy last month during January 2012 at Orange County CA real estate.

The Orange County Register has reported that Orange County CA home sold prices were below $400,000 in January 2012 for the first time in 33 months.

Orange County’s median home price - price at the midpoint of all sales - was $392,000 - down $23,000 or 5.5% from January 2011 - while sold prices were down during January at many of the OC zip code market areas.

Orange County CA home sales were at 1,872 units during January 2012 - which is down 3 percent from January 2011 last year - and 26 percent below the January average since 1988.

Investor buyers like this Orange County home resale market - 28.6 percent of Orange County homes sold during January 2012 were to investors and second home buyers.

Shortened Time Frame From Default to Foreclosure at Orange County CA Real Estate

10,898 Orange County CA properties are in the foreclosure pipeline as of today - February 15, 2012 - after filing of notice of default and prior to trustee auction sale at end of foreclosure.

A recent trend at Orange County Ca real estate is that time from default to foreclosure (average number of days) has been significantly reduced since last year.

California is a non-judicial foreclosure state. Time to foreclose is the average number of days between the filing of the Notice of Default and the final sale at trustee auction after foreclosure during any specified month.

During January last year 2011, it took average of 338 days for lender/lienholders to complete foreclosures at Orange County - that time frame was reduced to 284 days last month January 2012.

At Irvine CA real estate the time frame from default to foreclosure was 416 days last year during January 2011 - that average time was reduced to 223 days this year during January 2012.

New California Smoke Free Housing Law 2012

California New Smoke Free Housing Law for 2012

The California Smokefree Housing Law (SB 332) went into effect on January 1, 2012 - added Section 1947.5 to the California Civil Code- and gives multifamily property owners and managers the power to prohibit smoking in rental units.

This authorizes a landlord of a residential dwelling to prohibit the smoking of tobacco products on the property, in a dwelling unit, in another interior or exterior area, or on the premises on which the dwelling unit is located.

This new law makes requirements on notices and leases that a landlord who prohibits smoking pursuant to this authority is subject to federal, state, and local requirements governing changes to the terms of a lease or rental agreement for tenants.

California owner/landlords had prior legal authority to prohibit smoking - this new law gives them platform for new programs to enforce smoking bans in multifamily housing communities.

City of Pasadena is even more strict with its smoke free housing law for multi-family units 2012.

The City of Pasadena is leading the California trend and has banned smoking in all multi-family units including condominiums and townhouses, and prohibits smoking in all common areas and inside units. See the Pasadena city ordinance at "Reduction of Drifting Tobacco Smoke in Multi-Unit Housing."

Irvine CA Real Estate Market Update - February 2012

Irvine is the economy powerhouse at Orange County CA - has more jobs for employees than any other city of it size (with more than 200,000 people) in Southern California - and sells more real estate than other areas at Orange County.

Irvine has 572 homes now listed for resale with average listing price of $953,253.

121 of those listed are short sales, and 31 of those listed are REOs. So 26.5 percent of current Irvine for sale listings are distressed properties.

Realtors and brokers resold 2,201 Irvine homes last year during 2011 - with average sold price of $638,742.

443 of those sold homes last year were short sales (20 percent of market)
218 of those sold homes were REO lender owned after foreclosures (10 percent of market).

132 Irvine homes were resold last month during January 2012 - with average sold price of $622,470.

Since there are 572 Irvine homes now listed for resale and 132 sold during January, it would theoretically take 2.3 months to sell all homes now listed at this rate. Balanced would be about 4.5 month, so this Irvine market favors the sellers.

Strategy for Your Orange County CA Real Estate Short Sale Success

Issues are sometimes overlooked and trip up short sale sellers at Orange County CA real estate.

These and lender requirements for properties should be reviewed carefully at the start of the process, so short sellers don't get surprised with negative lender response and rejections.

Who Owns the Loan - It's important to determine who owns the notes and deeds of trust (as used in California). If you are dealing with a third party negotiator who works for a lender, you need to confirm name and address of the lender, investor, and separate negotiator. It's also important to find out what authority to negotiate has been granted to the third party negotiator.

Lender's short sale process - Sellers and their agents must find out at the earliest possible time about the specific lender, its negotiator, and its process for considering and approving a short sale.

Buyers Should Make Clean Offers - Lenders and their negotiators like to see clean and easy offers in short sales. Sellers should encourage buyers to clear as many of their contingencies as possible in their offers, so those offers are easy to understand and approve by lender/lienholders.

Incidental fees - Lenders for sellers in short sales don't usually agree to pay much, if any, of the outstanding incidental costs at closing - such as title fees, survey fees, unpaid utility bills, and document delivery fees.

Home and property inspections - Buyers should bite the bullet and get their home inspection completed as soon as possible and not wait until after lender approval of the sale. Buyer hesitation on this can hurt them when inspection eventually turns up something they don’t like. Buyers should get comfortable as soon as possible with the property condition.

Buyer Contingencies - Most of the same buyer contingencies will apply in short sales as in regular equity deals. Buyers will need to make sure they can get their money organized and financing before asking lender for sellers to approve the short sale.

Homeowners association financial condition - About 1 in 4 people at Orange County CA lives in a community where there are homeowner association rules and assessments. Some HOAs are in poor financial condition, and short sale sellers need to have this information from the start, including review of financial documents from the HOA, for eventual disclosure to buyers.

Homeowner association liens for unpaid assessments - It's common in short sales in California that the seller is in arrears on HOA dues and assessments. HOAs usually file and record their liens to protect right to recover through sale of the property. Sellers need to find this out early, so it can be presented to the lenders and negotiated.

New California Laws Impacting People Living Where There are Homeowner Associations

About one in three people in California now live in communities where there are homeowner associations, and new California laws impact those people.

CA Senate Bill 150 - new CA law for 2012 - Owner's right to rent out units at homeowner association community - prohibits associations from restricting owners' abilities to rent their properties unless a rental restriction was in place before the owner purchased the property. This section of the new law applies to a governing document provision that becomes effective on or after January 1, 2012, and requires owner/sellers to provide a statement describing any applicable rental restriction to potential buyers.

CA Senate Bill 209 - new CA law for 2012 - governing electric vehicle charging stations - restricts homeowners associations from prohibiting or restricting the installation of an electric vehicle charging station, although associations still have jurisdiction over the approval process for such stations. Owners will be responsible for the maintenance costs associated with charging stations and for any commonly metered electricity. Owners will also be required to obtain an umbrella liability insurance policy that names the association as an additional insured.

Senate Bill 563 - new CA law for 2012 - new requirements regarding the actions of homeowner association boards between meetings.

Homeowner associations must notify members at least two days prior to a meeting of the board's executive session.
Allows for meeting notifications to be sent electronically to homeowners and permits board meetings to be conducted by teleconference as long as they are conducted in a manner that protects the rights of members.
Notices of teleconference meetings must identify a physical location so members can attend and requires that at least one member of the board be present at the location.
Board of homeowner associations are prohibited from conducting a meeting via a series of electronic transmissions, such as email, except to conduct an emergency meeting.

These news laws are part of the California Civil Code starting at section 1350 re condominium, cooperative and planned unit development communities.

Positive Economy Trends Appear at Orange County, California

There are positive local economic trends appearing at Orange County CA in several sectors.

Job numbers for Orange County CA during December 2011 had big year-over-year gain in number employed - largest increase in number of OC working people since January 2001 (11 years ago).

Lots of Orange County workers are still out of work. However, December 2011 had lowest jobless count and lowest local unemployment rate since early 2009.

Orange County started 2012 with largest labor force in three years.

Food service business was a big job creator for 2011, and November 2011 set a record high of 143,200 Orange County restaurant workers.

Store owners added jobs in 2011, and November retail worker count was the highest for local merchants in three years.

Retail businesses added jobs during last three months of 2011 to meet holiday shopping, which was biggest year-end staffing up numbers since 2007.

New cars are selling again at Orange County - with year-to-date sales through October 2011 up 16 percent.

2.1 million square feet of local office space were leased out during 2011, which was biggest office leasing at Orange County since 2005.

Orange County builders took out permits for 4,818 homes, condo units and apartments during 2011, and that was up 56 percent vs. 2010.

I don't know whether these positive economy trends will hold strong for 2012, or whether we will have sustained economy growth at Orange County during this time. We hope for the best for our Orange County economy, that private industry jobs will increase and buyer demand for real estate will be strong.

Acres of parkland per 1,000 residents: 36.5 (Irvine is 10th highest)

Playgrounds per 1,000 residents: 2.8 (Irvine is 29th highest)

Violent crimes per 1,000 residents: 0.6 (Irvine is 5th lowest)

Unemployment rate: 6.7% (Irvine is 13th lowest)

Adults with at least a high school degree: 95.7% (Irvine is 2nd highest)

AOL real estate said:

"Irvine is a perfect city for parents who want their children to enjoy the outdoors.

"The planned community was developed with a focus on greenbelts, and features many bike paths and parks, including the recently established Orange County Great Park, which is still under construction.

"Irvine has one of the lowest rates of violent crime among all major cities. Its unemployment rate for 2011 was relatively low, at 6.7%. Like much of Orange County, Irvine suffered far less than other areas from the housing crisis."

Mortgage Debt Forgiveness Tax Relief by U.S. Law Set to Expire at End of This Year 2012

U.S. law - Mortgage Forgiveness Debt Relief Act of 2007 - applies to debt forgiven in calendar years 2007 through 2012 - including possible debt forgiven through SHORT SALE process.

For purposes of income tax, this law allows for exclusion of income realized as a result of modification of the terms of a mortgage, or foreclosure, for those who qualify on their principal residence.

Any person participating in a SHORT SALE and who wants to qualify under the Mortgage Forgiveness Debt Relief Act of 2007 will need to get that home sold and closed escrow before the end of this year 2012.

Some forgiven debt is taxable. This U.S. law - Mortgage Forgiveness Debt Relief Act of 2007 - provided tax relief to some people who owned and lost their home in foreclosure or who participate in a SHORT SALE.

When people qualify according to this Mortgage Forgiveness Debt relief act of 2007, the amount of debt to the lender that is forgiven in the short sale would not be taxable.

People who are on the fence about listing their homes for SHORT SALE need to get those on the market now and as soon as possible. A home listed for SHORT SALE too late during this year of 2012 will probably not get successful conclusion by the end of 2012 (signed purchase contract, delivered, concluded with close of escrow by the end of the year).

It's important for any home owner/seller considering a SHORT SALE to list the property as early as possible — especially since the short sale approval and completion process can take anywhere from 4 weeks to 12 months.

There are significant restrictions to qualify for this income tax relief on debt forgiveness.  You must consult with an experienced income tax professional or attorney to learn whether you qualify for this income tax relief on possible short sale of your property.

Irvine's mayor said that Irvine has a large number of jobs located in the city (about 190,000) in comparison to number of its residents (212,000).
Irvine CA real estate for 2011:

2002 Irvine homes were resold during this past year 2011.
That number of Irvine homes resales during 2011 was higher than any other Orange County city.
Buyers paid an average of $638,990 for Irvine resold homes during 2011.

66% of homes sold were standard equity sales
23% of homes sold were short sales
11% of homes sold were foreclosures
Buyers paid more than 1.27 billion dollars for all Irvine resold homes during 2011.

Buyers paid more money buying Irvine resale homes during 2011 than any other Orange County city.

What Irvine CA home and property sellers can expect for 2012:
Irvine will continue with solid job and private employer numbers during 2012.
Irvine homes to be resold during 2012 will probably be similar to 2011.
Number of Short sales will probably increase

Home Mortgage Loan Rates Continue at Record Lows

Mortgage loan rates reached new all-time lows last week and moved home buyer affordability even higher.

Rates on 30-year fixed mortgages have been at or below 4 percent for the last eight weeks and now are almost 0.9 percentage points below where they were at the beginning of the year. So home buyers are now paying over $1,200 less per year on a $200,000 loan.

Mortgage rates for week ending December 22, 2011:
30 year fixed rates averaged 3.91 percent, with an average 0.7 point, which beat prior week’s 3.94 percent record. A year ago at this time, 30-year fixed rates averaged 4.81 percent.

15 year fixed-rate mortgages averaged 3.21 percent, with an average 0.8 point, matching last week’s all-time low. Last year at this time, the 15-year mortgage averaged 4.15 percent.
5-year adjustable-rate mortgages averaged 2.85 percent this week, with average 0.6 point, a new record after dropping from last week’s 2.86 percent average. Last year at this time, 5-year ARMs averaged 3.75 percent.

1-year ARMs averaged 2.77 percent this week, with an average 0.6 point, also a new record after falling from last week’s 2.81 percent average. A year ago at this time, the 1-year ARMs averaged 3.40 percent.

Average sold price for 2011 is down 31.7% from peak year during 2007

During 2010 - 27,348 Orange County homes were resold - average sold price at $547,404.
During 2009 - 28,285 Orange County homes resold - average sold price at $508,231.
During 2008 - 24,591 Orange County homes resold - average sold price at $567,409
During 2007 - 20,621 Orange County homes resold - average sold price at $767,594

2007 was peak year for home selling prices.

Newport's annual Christmas Boat Parade is scheduled to start on December 14 this year.
Newport Beach is famous for its emerald green and blue Pacific ocean waters, surfing and sand, sunsets, beaches and harbor, kayaking, sailing, fishing from the piers, beach volleyball, great restaurants, people watching and fun.

During December Newport Beach residents and business owners are decorating their homes, businesses and boats.
Newport Beach will celebrate the 103rd Annual Christmas Boat Parade, December 14 to 18 - themed “Feelin’ Christmas-sea,”
The event is presented by the Commodores Club of the Newport Beach Chamber of Commerce.

For more than 100 years Newport Beach’s Christmas Boat Parade has provided fun experience for spectators and residents - with about 200 decorated vessels - yachts to canoes, through Newport Harbor. This boat parade is the oldest of its kind in the US and attracts a huge number of spectators.

New CA Law to Protect an Owner's Right to Rent Out a Condo Home

Some California homeowner associations have been changing governing documents to stop condo owners from renting out their units.
New California law (CA Senate bill 150) protects an owners right to rent out their units in common interest developments starting on January 1, 2012.
An owner in a California common interest development is exempt from any prohibition in a governing document against renting or leasing the unit, unless that prohibition was in effect before the owner acquired title the unit.

In other words - a condo association in California cannot change its private law and stop an owner of a unit from renting it out (as long as the private law change became effective after the owner's purchase).

When renting out a unit, the owner must give the HOA verification of the owners acquisition date, and name and contact information of the prospective tenant.
An owner right to rent under this law does not terminate for certain transfers of title, including, but not limited to, probate, spousal, parent-to-child, adding a joint tenant, and other transfers exempt from property tax reassessment.

For sale transactions, the required HOA disclosures must include a statement describing any prohibition in the governing documents against renting or leasing. This new law does not apply to rental prohibitions in HOA governing rules in effect before 2012.

What Mortgage Broker Fees Are Legitimate

Mortgage brokers are usually paid their commission and fees at closing.
Such mortgage broker commissions are based upon their being able to find the buyer a loan, process the loan application, serve as liaison between you and the lender, and to safely handle the mortgage from application through the closing.   A mortgage broker's commission is generally called an "origination fee."

Mortgage broker processing staff and other expenses are also paid at closing and can have various labels, such as processing fee, document fee, recording fee and others.

Legitimate fees charged by mortgage brokers to cover their expenses can include:

Appraisal fee - Most lenders collect this fee in advance, after you are approved for a loan and get into contract on a house (before your transaction closes).

Application fee - Some lenders charge an application fee, and others ask applicants to pay advance credit report fees.
Rate-lock extension fee - Some mortgage brokers charge such fees of one percent of loan amount if after application the interest rate needs to be guaranteed for a long period of time.

Other miscellaneous fees - to be clarified with specifics in the HUD estimated closing statement.
